This comes down to determining whether or not the younger one who was raped was in fact practicing self-ownership and consent of the act. It would have to be determined on a case by case basis. With that said, if a 17 year old consensually has sex with a 19 year old it would be handled much differently than a 50 year old with a 13 year old. But also keep in mind that who's to say a 19 year old isn't more prone to being statutorily raped than a 17 year old? It depends on the person and the circumstance. Courts would work through a pretty good understanding of how to handle this based around property. Is the person practicing self-ownership? Is the person acting as an adult or as a child? Is the person physically mature and able to reproduce sexually? All of these things come into account.
